• Use pre-designed templates and set aspect ratios
• Generate preview keyframes and short videos
• Download assets with commercial use rights

3. User Accounts

To use certain features, you may need an account. You agree to:

• Maintain the security of your password and account
• Update your information promptly
• Be at least 18 years old or of legal age in your jurisdiction

4. Acceptable Use

5. Intellectual Property

The Service and its content are owned by ProductAdGen or its licensors and protected by IP laws. You may not use our trademarks without prior written consent.

You retain ownership of content you submit but grant us a worldwide, non-exclusive, royalty-free license to operate and provide the Service.

User Uploaded Content & License

• You retain ownership of your uploads (images/videos); to provide the Service, you grant us a revocable, worldwide, non-exclusive, royalty‑free license to process, cache, and display such content as necessary
• We will not use your uploads to train third‑party foundation models except with your explicit consent

Storage, Retention & Deletion

• Uploads and generated assets are stored in controlled environments with encryption and access controls
• We retain content only as long as needed to provide the Service; you can delete items in‑product. Deletion removes content from live systems; backups may persist for a limited time

User Content Responsibility: You represent and warrant that all content you submit (including product photos, text descriptions, etc.) is either your original creation or you have obtained proper authorization to use it. You may not upload content containing third-party trademarks, copyrighted materials, or other intellectual property unless you have explicit permission to use such materials.

You shall be solely responsible for any legal disputes or damages arising from your violation of the above warranties and shall indemnify ProductAdGen for any losses incurred as a result.

6. Fees and Payments

If you purchase paid features, you agree that:

• Fees and applicable taxes are due as shown at checkout
• Transactions are processed by third-party providers (e.g., Creem) and subject to their terms
• Amounts are non-refundable except as required by law or under our Refund Policy

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, PETADGEN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Indemnification

You agree to defend, indemnify, and hold harmless ProductAdGen and its affiliates from claims arising out of your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate access immediately if you breach the Terms or for compliance/safety reasons. Sections that by nature survive termination will continue to apply.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand our data practices.

We may update these Terms from time to time. For material changes, we’ll notify you and apply changes after a reasonable period.

12. Content Safety and Prohibited Use

You agree not to use our Service to generate inappropriate, adult, explicit, or NSFW (Not Safe For Work) content. Our AI models include built-in safety mechanisms that automatically detect and refuse to generate such content. These safety measures are integral to the AI technology and cannot be bypassed or disabled.

Any attempts to circumvent these safety measures or generate prohibited content may result in immediate account suspension or termination. We reserve the right to monitor content generation patterns and take appropriate action to maintain platform safety.

13. Governing Law and Venue

These Terms are governed by the laws of California, United States, without regard to conflicts principles, with exclusive jurisdiction in the courts of San Francisco County, California.
